Website purpose

The Personal Property Securities Register (PPSR) is a form of electronic noticeboard where secured parties can record specific details about security interests in personal property.  

The register was established by the Personal Property Securities Act 1999 (PPSA) and the Personal Property Securities Regulations 2001. 

Personal property is given a wide definition by the Personal Property Securities Act 1999 (PPSA).  With a few exceptions it covers any property someone can own.  The most significant exceptions are land and ships over 24 metres in length.

All searches and registrations are completed via the internet; there are no paper forms.  The register is updated instantly, as soon as a financing statement has been registered it is available for searching.

Registration

Registration on the PPSR is one way to secure priority over personal property that is subject to a security interest.  To register on the PPSR you must be a registered user and you must also register as a Secured Party Group (SPG).

The actual security agreement is not registered on the Personal Property Securities Register.  A notice of the agreement is posted on the Register, by way of registering a financing statement.  Secured parties must take particular care when registering a financing statement to ensure the right information is included.

 

Searching

There are many reasons for searching the PPSR.  A secured party is likely to search the PPSR as part of the process leading up to entering into a security agreement.  Consumers may search the PPSR before buying an item of personal property to check there is no money owing.

If you want to conduct a search, you will have to be a registered user.  If you prefer, you can engage an agent to search on your behalf.  PPSR staff are not able to conduct searches of the register for you.

You, or your search agent, will also be required to declare on screen that your search is for one of the purposes set out in the Personal Property Securities Act 1999.
